GENERALITIES

These general terms and conditions of sale (hereinafter GTC) apply to all transactions concluded between the Suard company (hereinafter Suard) and its customers, whether natural persons of legal age or legal entities, from the online shop www.confiserie-suard.ch, without restriction or reservation.

All products sold on the website www.confiserie-suard.ch are foodstuffs and perishable. Their characteristics as well as images, dimensions and prices are available on Suard's website. The buyer is required to read them carefully before placing an order. They are solely responsible for their purchase. The images and designs published on the online site www.confiserie-suard.ch are not contractual and cannot engage Suard's liability. For each item sold on the website, the customer must refer to its description to learn more about its characteristics.

The products published on the website are sold subject to available stock as indicated at the time of order placement.

These GTC are available at any time on www.confiserie-suard.ch and prevail, if applicable, over any different and/or contradictory version or document. The customer declares having read the GTC on the website and accepts them by validating their order. These GTC may be adapted to new situations but the version applicable to the customer's purchase is the one in force on the website at the date of order placement. Unless proven otherwise, the data saved in Suard's IT system shall be conclusive for all sales concluded with the customer.

PRICES

Prices are indicated in Swiss francs, net amounts, VAT included.

They do not include shipping costs, which are charged additionally and calculated prior to order placement. The payment requested from the customer corresponds to the total amount of their purchases, including these costs. An invoice is automatically sent to the customer by email upon order confirmation.

Products are supplied at the prices indicated on the website www.confiserie-suard.ch at the time the customer places the order. Prices bind the parties until order confirmation by Suard or for the duration indicated in the order confirmation.

Price changes related to modifications of taxes, duties or shipping costs are reserved.

CONTRACT CONCLUSION

The customer's order is placed online. The contract is concluded when the order confirmation is sent to the customer by email.

Delivery of the ordered products is at the customer's expense. These costs are indicated separately on the invoice.

In case of impossible delivery or delay caused by incorrect delivery address data provided by the customer, absence of the recipient or customs issues, Suard cannot be held responsible.

Delivery times given are indicative only. Suard cannot be held liable for delays beyond its control and such unforeseen events do not entitle the customer to withdraw from the sales contract or claim compensation.

Our delivery commitment is null in case of failure or non-compliance with supply deadlines by our own suppliers and to the extent that this unavailability is not attributable to Suard. In case of product unavailability, we will inform you as soon as possible.

DELIVERY AND ORDER COLLECTION

PAYMENT METHODS

Orders, whether shipped by post or collected in store, must be paid in advance via our online payment system.

Possible payment methods: VISA / MasterCard / Maestro / Postcard

The customer guarantees Suard that they hold any necessary authorisations to use the payment method chosen when placing the order. Suard reserves the right to suspend any order processing and delivery in case of refusal of payment authorisation by officially accredited institutions or in case of non-payment. Suard also reserves the right to refuse to deliver or honour an order from a buyer who has not fully or partially settled a previous order or with whom a dispute is ongoing.

ORDER CANCELLATION, RETURNS OR PRODUCT EXCHANGES

Once an order is validated, it can no longer be cancelled or modified.

Products are neither taken back nor exchanged.

GOODS INSPECTION / CLAIMS

The customer must check the condition of the delivered products. Any claims regarding quality and completeness must be communicated to Suard immediately, but no later than 24 hours after delivery, otherwise the delivery will be considered accepted. After this period and if these conditions are not met, the products are deemed compliant and free from any apparent defect and no claim will be validly accepted by Suard.

Suard cannot be held responsible for damages occurring during transport or resulting from incorrect storage of the goods after receipt by the customer or their collaborators.

DATA PROTECTION

Data necessary for order execution are saved and, if applicable, transmitted within the framework of contract processing to companies responsible for execution. Otherwise, recorded data are not transmitted to third parties, except for creditworthiness checks or, if applicable, debt collection services. Data are used within Suard for customer relationship maintenance purposes.

Correspondence concerning transactions may be conducted electronically. Explicit attention is drawn to security risks represented by data transmission by email, which is not under Suard's responsibility, such as virus transmission, data damage and loss or access by unauthorised third parties. By placing the order, the customer allows Suard to send documents and other data by unencrypted emails.

APPLICABLE LAW AND COMPETENT JURISDICTION

Contracts are exclusively subject to Swiss law, excluding the Vienna Convention (CISG).

Fribourg (Switzerland) is the exclusive legal venue, subject to appeals before the Swiss Federal Tribunal.

LEGAL NOTICE

The content of Suard's website is the property of Suard and its partners. Any dissemination, publication, modification, use without written agreement from Suard is prohibited.
