Senior Legal Counsel APAC & Tech Ops

We are looking for a Senior Counsel responsible for providing strategic and operational legal support to the APAC CSL Vifor commercial organization. The Senior Counsel is also responsible for support for CSL Vifor’s Tech Ops function.

Roles & Responsibilities

Provide legal support and strategic counsel for CSL Vifor’s operations, including the operations of Vifor Fresenius Kabi (Beijing) Pharmaceutical Consulting Co Ltd (CSL Vifor’s joint venture with Fresenius Kabi in mainland China), in the Asia-Pacific region excluding Australia and New Zealand. Responsibilities include:

  • Building and maintaining trusted working relationships with CSL Vifor business leaders in the region, and developing a strong understanding of the CSL Vifor business and its strategic plans and priorities.

Providing first-chair legal support for CSL Vifor’s commercial operations in the region, including:

  • supporting the negotiation, drafting, and execution of sales, distribution, marketing, licensing, and other contracts, working in conjunction with Legal Services in the region as appropriate;

  • reviewing and advising on advertising and promotional materials;

  • advising on engagements with third party stakeholders including governments, payers, health care practitioners, and patients and patient associations;

  • providing strategic counsel on relevant pharmaceutical and other laws, regulations, and codes, including with respect to requirements and procedures for obtaining, maintaining, and renewing marketing authorizations and product licenses for CSL Vifor’s products; and providing regular training to CSL Vifor personnel on key legal topics in the region.

Providing corporate legal support for CSL Vifor’s operations in the region, including providing advice and legal / company secretarial support (in conjunction with the CSL Company Secretary organization) for:

  • CSL Vifor group companies in the region, including for the establishment of new CSL Vifor group companies as the need arises; and

  • the Vifor-Fresenius Kabi joint venture company in mainland China, including support for the meetings and activities of its Board.

Managing disputes and litigation to protect CSL Vifor’s business interests in the region.

In coordination with the Global Head of Labor & Employment Law, providing legal support for CSL Vifor employment matters in the region.

In coordination with Enterprise Risk, Ethics, and Compliance, providing support for compliance matters in relation to CSL Vifor’s operations in the region as they arise, including regulatory inquiries or investigations and whistleblower complaints.

Coordinating as required with Legal Partners supporting CSL Behring and CSL Seqirus operations in the region, with the CSL Seqirus Legal Partners supporting CSL Vifor’s operations in Australia and New Zealand, and with counterparts worldwide.

Provide comprehensive legal counsel and support for CSL Vifor’s Tech Ops activities, including:

  • Advise on a broad range of legal issues related to the activities of a global pharmaceutical business, including GxP matters.

  • Develop and maintain a broad and deep knowledge of the CSL Vifor’s Tech Operations, including products, strategies, and long-term goals, to provide business-focused, highly actionable advice to enable optimal, risk-informed decisions by the business in alignment with Lead Counsel Tech Ops and Enabling Functions.

  • Supervise and manage litigation and litigation exposure to protect the interests of CSL Vifor, in consultation with the Lead Counsel Tech Ops and Enabling Functions, CSL Vifor.

  • Advise on the legal aspects of contract strategy and execution for all CSL Vifor Tech Operations functions to provide outstanding customer service; Review, draft and negotiate a range of high-value agreements, such as manufacturing and capex agreements.

  • Participate in the Global Operations Legal working group and support enterprise-wide capex support strategy.

Key Requirements

  • Bachelor’s degree and J.D. or equivalent foreign degree

  • Bar admission in Switzerland or permission to practice in-house.

  • LL.M. preferable

  • Strong knowledge of one the main Chinese languages

  • 10+ years’ international corporate or law firm legal experience

  • 5 years' experience in the pharmaceutical, biotech or medical device industry

  • 5+ years' international experience for multi-jurisdiction region

  • Solid experience in Tech Ops support, supply and manufacturing agreements and legal matters

  • Strong analytical skills with the ability to develop and apply pragmatic solutions to complex legal / regulatory matters

  • Self-motivated, self-starter, results oriented

  • Strong contract drafting and negotiation skills and experience with various agreements

  • Excellent communication, negotiation and MS Office skills

  • Proactive and service-oriented team player
