General terms and conditions of delivery (GTC) of fuhrer + bachmann ag (f+b)
1. Scope of delivery
The written order confirmation from f+b is authoritative regarding the scope of delivery. Any modification requires written confirmation from f+b. The shipment and transport of the goods are at the buyer's risk.
2. Prices
They are understood in francs (Swiss currency, or in € for EU countries), excluding VAT, and unless otherwise stipulated, net ex works without packaging or any deductions.
3. Payment terms
1. Payments must be made within 30 days net from the date of invoicing or, in case of contrary stipulation, according to the indications on the invoice.
2. The buyer is not authorized to reduce or defer payments due to claims, delays of any kind, or unrecognized counterclaims by the supplier.
3. If payment is not made within 30 days from the date of invoicing or according to the specific indications on the invoice, the buyer defaults on their obligations and must pay default interest.
4. Retention of title
The delivered goods remain the property of f+b until full payment of the purchase price and all other claims due from the buyer to f+b due to their business relationship. The buyer empowers f+b, in the sense of the retention of title mentioned in Article 715 of the CCS (competent court of Winterthur/Switzerland), to unilaterally register the retention of title in the property reserve register of the competent authority.
5. Warranty conditions
5.1 Generalities
1. In addition to the legal warranty, fuhrer+bachmann ag grants users of fuhrer+bachmann ag devices a manufacturer's warranty. This applies to all fuhrer+bachmann ag devices that have been purchased directly from us in Switzerland or indirectly through an authorized specialized dealer who procures devices from fuhrer+bachmann ag.
2. An "User" in the sense of this manufacturer's warranty is any natural or legal person who owns the device and did not acquire it for resale purposes. An "Original Customer" is any user who was the first to acquire the device in Switzerland from fuhrer+bachmann ag or who acquired it indirectly through an authorized Swiss specialized dealer.
5.2 Content and scope of the warranty
1. fuhrer+bachmann ag guarantees that its devices function perfectly.
2. The warranty applies exclusively to the use of the devices in Switzerland.
3. The warranty does not apply to the following defects: misuse or non-compliance, use of force or intervention by third parties, damage due to non-compliance with assembly or usage instructions, non-compliant assembly, overloading of the device, use of unauthorized tools or accessories, non-compliance with maintenance and safety guidelines, introduction of foreign bodies into the device.
4. Damage to wear parts due to normal wear related to the use of the device is not covered by the warranty.
5. Any warranty claim is void if the annual maintenance of the device cannot be certified by a corresponding official document, as required by the manufacturer's guidelines.
5.3 Duration and effect of the warranty
1. The warranty period is 12 months.
2. The warranty takes effect on the date of purchase by the original customer, at the latest 3 years after the date of manufacture.
3. The warranty period is not extended if services are performed under this warranty, particularly in the case of repair or replacement of the device. In this case, the warranty period does not reset to zero.

5.4 Prerequisites for the warranty
1. The device has been acquired through an authorized dealer or directly from fuhrer+bachmann ag in Switzerland, where it is assembled.
2. In accordance with the following conditions, fuhrer+bachmann ag remedies defects in the device due to material and/or manufacturing errors if they are communicated to us as soon as they are discovered and within a period of 12 months from the date of the invoice issued to the original customer. It is the consumer's responsibility to provide proof that the warranty has not expired (for example, by presenting the original customer's proof of purchase).
Fuhrer+bachmann ag may determine the effective date of the warranty according to the date of manufacture.
5.5 Warranty services
1. During the warranty period, fuhrer+bachmann ag examines the device to determine if the case is covered by the warranty. If the case is covered by the warranty, fuhrer+bachmann ag repairs the device at its own expense or replaces it.
2. The choice of warranty service (repair or exchange) is at the discretion of fuhrer+bachmann ag.
3. If the device is no longer available at the time the warranty case is recognized, fuhrer+bachmann ag has the right to exchange the affected product for an equivalent device. fuhrer+bachmann ag then becomes the owner of the defective device or certain of its parts.
4. Warranty services do not result in an extension of the warranty period or the opening of a new warranty period.
5. The warranty period applicable to spare parts ends at the same time as the warranty period applicable to the device as a whole.
5.6 Other claims
1. Other or additional claims, particularly for the replacement of the device, for example in the case of damage occurring outside the device, are excluded unless a legally mandatory liability is defined.
2. Transport or transport costs are borne by the owner of the device.
3. Defects do not entitle to a full or partial refund of the purchase price of the device.
5.7 Data protection
Personal data is used exclusively for the purpose of processing orders and for the possible execution of the warranty, always in compliance with the conditions governing data protection.
5.8 Applicable law / Competent court
This warranty is governed by Swiss law, excluding the Vienna Convention (United Nations Convention on Contracts for the International Sale of Goods ratified on April 11, 1980 in Vienna).
The place of performance of the obligations arising from this warranty is Elsau/Winterthur (Switzerland). To the extent permitted, the competent court is that of Elsau/Winterthur (Switzerland).
6. Validity
These general terms and conditions of delivery are mandatory subject to their acceptance by management.
Claims must be made within 8 days.
