Position: Partner – Real Estate Law
Location: Zurich
Workload: 100% full-time
Objective
As a senior real estate lawyer, you advise domestic and international clients on high-profile real estate transactions and real estate law matters throughout Switzerland. You possess profound expertise in Swiss real estate law, combined with a solid command of the associated corporate, tax and financial law aspects. You work closely with our notarial, M&A and tax practice groups and act as a trusted advisor to entrepreneurs, family offices and institutional investors on all matters relating to the acquisition, development and structuring of real estate.
Responsibilities
Real Estate Transactions
- Advising buyers, sellers and investors on the acquisition, disposal and financing of residential, commercial and mixed-use properties in Switzerland
- Leading legal due diligence on real estate assets, including ownership verification, land register analysis, encumbrances, easements, building rights and compliance with building regulations
- Negotiating and drafting purchase agreements, option agreements, pre-emption rights and transfer documents
- Structuring and executing sale-and-leaseback agreements, joint ventures, co-ownership structures and portfolio transactions
- Coordinating with notaries, land registry offices, surveyors and financing banks to ensure smooth transaction processing
- Advising on distressed real estate, enforcement proceedings and asset disposals in restructuring contexts
Development & Leasing
- Advising developers, owners and investors on real estate development projects, including building law, construction contracts and project structuring
- Drafting and negotiating commercial and private lease agreements, including anchor tenant leases and bespoke construction contracts
- Advising on property management contracts, facility agreements and service-level agreements
- Advising clients on zoning, building permits and administrative procedures before cantonal authorities
Structuring & Regulation
- Advising on restrictions applicable to foreign investors under the Lex Koller (Federal Act on the Acquisition of Real Estate by Persons Abroad) and structuring compliant acquisition and holding arrangements
- Advising on real estate holding structures, including direct ownership, SPV structures and real estate funds
- Supporting clients on real estate law aspects of estate planning, succession, trust and foundation agreements
- Coordinating with tax advisors regarding stamp duty, real estate transfer tax, capital gains and VAT implications of real estate transactions
- Advising on condominium ownership, co-ownership agreements and building rights
Client Relations & Business Development
- Building and maintaining long-term client relationships with entrepreneurs, family offices, developers and institutional investors
- Identifying cross-selling opportunities with the M&A, notarial, tax and litigation practice groups
- Contributing to thought leadership through articles, client seminars and representation at real estate industry events
- Mentoring junior lawyers and interns by sharing expertise and best practices
- Active use of AI-supported legal tools and participation in the firm’s ongoing innovation agenda
Performance Metrics
- Acquisition of mandates in real estate and related fields
- Contribution to cross-selling between the firm’s practice groups
- Targets for billable hours
- Client satisfaction and long-term client retention
- Marketing activities: newsletters, events, publications and digital content
Requirements
Education
- Admission to the bar – mandatory
- Excellent academic achievements in law; additional qualifications in real estate, tax or corporate law are a great advantage
- Further training or CAS/MAS in real estate or construction law is beneficial
Professional Experience
- 5 to 15 years of relevant professional experience in real estate law, ideally in a leading law firm or in the legal department of a real estate developer, bank or institutional investor
- Proven track record of independently managing complex real estate transactions
- Experience with cross-border real estate matters and international client structures is highly valued
Languages
- German – stylistically confident, legally precise written and oral expression (mandatory)
- English – stylistically confident, professional and fluent (mandatory)
- French, Italian or other languages are advantageous given the firm’s international client base
